In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the BrowserGamers.gg service.
1. OUR COMMITMENT
As a browser games platform, we host content from various sources, including direct developer uploads and licensed distribution networks. We are committed to ensuring that:
- Copyright holders' rights are respected.
- Infringing content is removed promptly when properly reported.
- We maintain a "Repeat Infringer" policy to ban bad actors from our platform.
2. REPORTING COPYRIGHT INFRINGEMENT (DMCA NOTICE)
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Upon receipt of the Notice as described below, BrowserGamers.gg will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.
Required Information for a Valid Notice:
- Identification of the Work: Clearly describe the copyrighted work you claim has been infringed. If multiple works are involved, providing a representative list is sufficient.
- Identification of the Material: Provide the specific URL(s) on BrowserGamers.gg where the allegedly infringing material is located. (e.g., https://browsergamers.gg/game/example-game).
- Contact Information: Your mailing address, telephone number, and email address.
- Good Faith Statement: Include the following statement: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
- Accuracy Statement: Include the following statement: "The information in the notification is accurate, and under penalty of perjury, I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
- Signature: Your physical or electronic signature (typing your full name acts as an electronic signature).

4. COUNTER-NOTICE PROCEDURE
If you believe that material you posted on BrowserGamers.gg was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice").
The Counter-Notice must include:
- Your physical or electronic signature.
- An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located.
5. REPEAT INFRINGER POLICY
BrowserGamers.gg does not tolerate repeated copyright infringement. While we do not require mandatory user accounts for gameplay, we employ technical measures to enforce this policy:
- First Offense: Removal of content and a warning (if contactable).
- Second Offense: Temporary blocking of IP address or upload privileges.
- Third Offense: Permanent ban of the user's IP address and device fingerprint from accessing the Platform.
6. FALSE CLAIMS
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages (including costs and attorneys' fees).
